Which translation, when

Why

Residence permit has no single German equivalent, because the German system splits what English bundles. The umbrella is the Aufenthaltstitel: § 4 Abs. 1 Satz 2 AufenthG lists the titles a foreigner may hold, the Visum of § 6 for entry and initial stay, the Aufenthaltserlaubnis of § 7, the Blaue Karte EU and the ICT cards for defined mobility, the Niederlassungserlaubnis of § 9 and the Erlaubnis zum Daueraufenthalt-EU of § 9a. On that list the Aufenthaltserlaubnis is one species, and a marked one: fixed-term and purpose-bound, granted for study, training, work, family reunion or humanitarian grounds, extended on application, with the Fiktionswirkung of § 81 Abs. 4 AufenthG keeping the old title provisionally alive where the extension is applied for in time. The unlimited layer carries its own names: the Niederlassungserlaubnis, unlimited and with free labour-market access, and beside it the EU-law Daueraufenthalt-EU; English permanent residence permit and settlement permit point there, and the seemingly natural unbefristete Aufenthaltserlaubnis is lay language for what the statute names differently. So the translation rule is a sorting rule. Where the source means the category, any residence title, the German word is Aufenthaltstitel; where it means the fixed-term species, Aufenthaltserlaubnis; where it means the permanent status, Niederlassungserlaubnis; and the reflex Aufenthaltserlaubnis for everything regularly converts an unlimited status into a limited one on paper. The edges matter too: the Aufenthaltsgestattung of the asylum procedure, the Fiktionsbescheinigung and the Duldung are papers without title quality, outside the § 4 catalogue, so residence permit is the wrong word for all three; and Union citizens need no title at all, their stay runs on free-movement law, held by the free movement entry, as the general permit-and-prohibition doctrine is held by the permit entry.

Typical mistakes

• Aufenthaltstitel is the umbrella and Aufenthaltserlaubnis the fixed-term species, so the reflex rendering flattens the § 4 system.
• A permanent residence permit is the Niederlassungserlaubnis, so writing Aufenthaltserlaubnis for it turns an unlimited status into a limited one.
• Aufenthaltsgestattung, Fiktionsbescheinigung and Duldung are papers without title quality, so residence permit misdescribes all three.

What matters

A relocation memo or visa questionnaire heading into German: the translation should sort each residence permit into Aufenthaltstitel, Aufenthaltserlaubnis or Niederlassungserlaubnis by what the source means, and keep the non-titles, Gestattung, Fiktionsbescheinigung and Duldung, out of the title vocabulary.
