Why
Legal professional privilege is a single common-law concept protecting lawyer-client communications from disclosure, and German law reaches similar results through separate specific rights rather than one privilege. The oral side is das Zeugnisverweigerungsrecht, the lawyer’s right to refuse to testify about what the client confided, § 53 StPO in criminal matters, § 383 Abs. 1 Nr. 6 ZPO in civil, paired with the lawyer’s duty of Verschwiegenheit, § 43a BRAO. The document side is a Beschlagnahmeverbot, the lawyer’s records largely protected from seizure, § 97 StPO. What is missing is both the unifying label and the arena, there is no single privilege doctrine and no discovery in which a party would assert privilege over documents it must otherwise produce, so the English question whether a document attracts privilege has no direct German counterpart, the German question is instead whether a witness may refuse or a paper may be seized. And the reflex is a trap of its own, das Privileg is a special right or entitlement, so privilege rendered as Privileg turns a confidentiality protection into a grant of favour. So privilege is reconstructed by asking which specific refusal or seizure rule applies, never left as one word.
