Occupational freedom is the Berufsfreiheit of Art. 12 Abs. 1 GG, one unified fundamental right covering the choice and the practice of an occupation, reviewed since the Apotheken judgment on the Drei-Stufen-Theorie. It is not the Gewerbefreiheit, the trade-law principle of § 1 GewO; the constitutional Beruf reaches the free professions and employment, and the demotion to trade law is the trap.

Why
Occupational freedom is the Berufsfreiheit, and the German architecture gives the translator three fixed points. The first is unity: Art. 12 Abs. 1 GG names the free choice of Beruf, Arbeitsplatz und Ausbildungsstätte and lets Satz 2 regulate the Berufsausübung, but since the Apotheken judgment the court reads choice and practice as one unified complex of occupational activity, the Regelungsvorbehalt covering both; the right belongs to alle Deutschen, with EU nationals brought level by Union law on a debated doctrinal route. The second is the review scheme the same judgment created, the Drei-Stufen-Theorie as a sharpened proportionality test: rules of mere occupational practice, the first tier, stand on sensible considerations of the common good; subjective admission requirements, qualifications the applicant can meet, form the second; objective admission barriers, closed to any effort of the applicant, form the third and demand the protection of an overriding important community good, in the founding case the health of the population. For translation the tiers are load-bearing: whether an English regulation, licensing requirement or quota reads as Ausübungsregelung, subjektive or objektive Zulassungsvoraussetzung decides the justification the German reader expects. The third point is the false neighbour: Gewerbefreiheit, the principle of § 1 GewO, is ordinary trade law and confined to Gewerbe, while the constitutional Beruf embraces every lasting activity creating and maintaining a livelihood, free professions and employment included. A text that renders occupational freedom as Gewerbefreiheit demotes the fundamental right to trade regulation and silently narrows who holds it. So the safe rendering is Berufsfreiheit, tiered where the source grades, and Gewerbefreiheit only where the source truly means the trade-law principle.

The machine gives occupational freedom as Berufsfreiheit, and where the source says freedom of trade it slides to Gewerbefreiheit; carried back into a fundamental-rights text, the slide demotes Art. 12 Abs. 1 GG to the trade-law principle of § 1 GewO and drops the free professions and employment from the right. The grading of the Drei-Stufen-Theorie, which sets the justification burden, vanishes with it.
