An implementing act is the Durchführungsrechtsakt of Art. 291 AEUV, adopted where legally binding Union acts need uniform conditions for implementation, under the comitology control of the member states. It is neither the delegierter Rechtsakt of Art. 290, that boundary lives in the delegated act entry, nor the Umsetzung of a directive into national law, which is transposition and a different operation altogether.

Wortfeldthe traps: the Umsetzung of a directive into national law, transposition, is not a Durchführungsrechtsakt but the member-state operation the directive entry holds; machine words like Implementierungsakt or Umsetzungsrechtsakt have no home in the Treaty vocabulary; and the sorting against the delegierter Rechtsakt, supplementing versus implementing, is held by the delegated act entry.

Why

Implementing act translates as Durchführungsrechtsakt, and the German word keeps a structure the English tends to blur. Art. 291 AEUV opens with the member states: under Abs. 1 they adopt all measures of national law necessary to implement legally binding Union acts, implementation is in the first place their business. Only where uniform conditions for implementing are needed does Abs. 2 let the basic act confer implementing powers on the Commission, or in specific duly justified cases and in common foreign and security policy on the Council; and Abs. 4 orders the element Durchführungs- into the title, so the species read Durchführungsverordnung and Durchführungsbeschluss in the Official Journal. The control side is the second marker: Abs. 3 places the supervision of the Commission with the member states, worked out in Verordnung (EU) Nr. 182/2011, the comitology regulation, through committees of national representatives deciding in the Beratungsverfahren or the Prüfverfahren with a Berufungsausschuss above them; on the delegated side, by contrast, Parliament and Council hold revocation and objection and no committee sits. For the translator two neighbouring operations must stay apart. The first is the delegierter Rechtsakt of Art. 290, supplementing or amending the basic act rather than implementing it, a boundary with procedure, control and attack routes hanging on it, held in full by the delegated act entry. The second is transposition: the Umsetzung of a directive into national law is a member-state legislative operation, the directive entry’s territory, and calling it an implementing act, or rendering implementing act as Umsetzungsrechtsakt or Implementierungsakt, mixes the Treaty’s levels; the drafting words are Durchführungsrechtsakt and, for the directive side, Umsetzung.

Typical mistakes

  • Implementation starts with the member states and the Commission acts only where uniform conditions are needed, so a rendering that makes the Durchführungsrechtsakt the default inverts Art. 291.
  • The control here is comitology, member-state committees under Verordnung (EU) Nr. 182/2011, so describing objection rights of Parliament and Council imports the wrong regime.
  • The Umsetzung of a directive is transposition, not a Durchführungsrechtsakt, and Implementierungsakt is machine German without a Treaty home.

What matters

Reviewing a German version of an EU compliance update: keep Durchführungsrechtsakt for the Art. 291 measure, name the species as the Official Journal does, Durchführungsverordnung, and hold the word Umsetzung back for what member states do with directives.
