Freedom of assembly is the Versammlungsfreiheit of Art. 8 GG, and the constitutional wording itself decides the regime: the right is to assemble ohne Anmeldung oder Erlaubnis, friedlich und ohne Waffen. Assemblies are permit-free; open-air assemblies carry a notification duty under ordinary law, and a translation that writes genehmigt where angemeldet is meant turns freedom into a licensing system.

Why
Freedom of assembly is the Versammlungsfreiheit, and Art. 8 GG writes the decisive point into its own text: alle Deutschen have the right to assemble ohne Anmeldung oder Erlaubnis, friedlich und ohne Waffen. Three consequences carry the entry. First the scope: friedlich and ohne Waffen are limits of the protected sphere, not statutory reservations, and the case law keeps them narrow, single violent participants do not rob a peaceful majority of the protection. Second the split of regimes: assemblies in enclosed rooms enjoy the guarantee without a written reservation and can be limited only by colliding constitutional law, while Versammlungen unter freiem Himmel stand under the reservation of Abs. 2, filled by the Versammlungsgesetz and, since the federalism reform, the assembly statutes of the Länder; that body of law is treated as polizeifest, shutting out recourse to general police powers where it applies. Third, and sharpest for translation, the difference between notification and permission: ordinary law attaches an Anmeldepflicht to open-air assemblies, § 14 VersG, but the constitution rules out any Erlaubnis by its wording, and the Brokdorf line draws the consequence, a ban resting on the missing notification alone violates Art. 8 GG, and spontaneous assemblies, which cannot be notified in advance, remain protected. English sources speak of unauthorised assemblies and permits; carried into German as ungenehmigte Versammlung or Genehmigung, the wording imports a licensing system the Grundgesetz forbids. So the safe rendering is Versammlungsfreiheit with the permit-free frame kept intact, angemeldet and nicht angemeldet for the ordinary-law duty, and genehmigt never.
Typical mistakes
- Friedlich und ohne Waffen limit the protected scope and are no statutory reservations, so reading them as licensing conditions misdraws the right.
- Enclosed-room assemblies are guaranteed without a written reservation, open-air assemblies under Abs. 2, so one uniform limitation picture misses the split.
- Notification is not authorisation: a ban on the missing Anmeldung alone violates Art. 8 GG and spontaneous assemblies stay protected, so genehmigt and ungenehmigt are the wrong German words where angemeldet is meant.

A protest or public-order passage heading into German: the translation should use Versammlungsfreiheit, keep assemblies permit-free by the constitutional wording, render notification duties as Anmeldung, and refuse Genehmigung vocabulary that would turn the freedom into a licensing system.
