Approximation of laws is the Rechtsangleichung, the Treaty’s own word for aligning national provisions, and its engine is Art. 114 AEUV: measures approximating the laws of the member states which have the establishment and functioning of the internal market as their object. Harmonisierung is the everyday synonym; the reflex Annäherung is the machine’s word, not the chapter heading’s.

Why
Approximation of laws translates as Rechtsangleichung, and here the German word is the older and firmer one, the English approximation being the Treaty’s own slightly awkward rendering of it. The engine is Art. 114 AEUV: for the objectives of Art. 26, Parliament and Council adopt, in the ordinary legislative procedure and after consulting the Economic and Social Committee, the Maßnahmen for the approximation of the Rechts- und Verwaltungsvorschriften of the member states which have the establishment and functioning of the internal market as their object; Maßnahmen means any form of act, regulation, directive or decision, and approximation means levelling the market-hurting divergences between national laws, alignment rather than codification. The edges give the norm its shape: Abs. 2 excludes tax provisions, the free movement of persons and the rights and interests of employed persons, which is why tax harmonisation travels through other bases; Abs. 3 commits the Commission to a high level of protection in health, safety, environment and consumer matters; Abs. 4 und 5 are the national safety valves, asymmetric by design: after a harmonisation measure and on notification to the Commission a member state may maintain provisions justified by the important requirements of Art. 36 or by the protection of the working environment or the environment, while introducing new provisions runs on the narrower Abs. 5 track only, environment or working environment, new scientific evidence, and a problem specific to that member state arising after the measure, with the Commission approving or rejecting the notified provisions within six months; and next to the general power stands Art. 115, unanimity, special legislative procedure, directives only, the old road that Art. 114 largely replaced. In the working vocabulary Harmonisierung serves as the everyday synonym of Rechtsangleichung and carries the practice pair, Vollharmonisierung where the Union act occupies the question and leaves no stricter national room, Mindestharmonisierung where it sets a floor the states may exceed, a distinction any compliance text needs. What the pair does not need is the machine reflex: Annäherung der Gesetze reads like diplomacy, the chapter heading says Angleichung der Rechtsvorschriften, and a legal text should follow it; the transposition mechanics of the directives that carry most approximation belong to the directive entry, the underlying shared internal-market competence to the shared competence entry.
Typical mistakes
- Art. 114 Abs. 2 excludes taxes, free movement of persons and the rights and interests of employed persons, so citing the general approximation power for a tax measure misstates the base.
- Vollharmonisierung closes the question and Mindestharmonisierung only floors it, so a compliance text that misses which kind applies misjudges the room for stricter national law.
- Annäherung der Gesetze is the machine’s word, the chapter heading says Angleichung der Rechtsvorschriften, and the working noun is Rechtsangleichung.
What matters
Corporate counsel summarising an internal-market directive for the German office: say Rechtsangleichung or Harmonisierung, state whether the measure fully harmonises or only sets a floor, and keep the Art. 114 base apart from the tax and employment fields it cannot carry.
What the machine misses
A machine pass turns approximation of laws into Annäherung der Gesetze, diplomacy instead of drafting; the Treaty word is the Rechtsangleichung of Art. 114 AEUV, internal-market measures levelling national divergences with the tax, free-movement and employee carve-outs of Abs. 2, and the soft calque loses both the chapter heading and the Vollharmonisierung question every compliance text turns on.
