LC40 : driving a vehicle having failed to notify a disability

Checked 22 July 2026 · How we check our figures

What it means

LC40 is LC30 without the lie: the duty under s. 94 RTA 1988 is to tell the DVLA when a notifiable condition arrives or worsens, and the offence is driving after that notification never happened. The list of notifiable conditions is DVLA guidance and longer than drivers expect, and deciding for yourself that you are fit is not the same as notifying: the assessment belongs to the DVLA, the duty to report belongs to the driver. The insurance shadow tracks the rest of the medical trio.

Points and how long it stays

3 to 6 points.

On the licence for 4 years from the date of the offence.

The LC codes are the licence's own offences, 3 to 6 points each on the 4-year offence clock, one everyday code and a medical trio. LC20 is the everyday one, driving otherwise than in accordance with a licence, s. 87 RTA 1988: the learner outside the conditions, the category that was never held. LC30, LC40 and LC50 share a spine that runs through the DVLA's medical file, the false fitness declaration, the condition never notified under s. 94, the driving after a medical refusal or revocation under s. 94A. Two shadows fall across the whole family: insurance, because cover generally stands on entitlement and IN10 often arrives on the same facts, and the DVLA itself, which usually moves against the licence before the courtroom moves at all. The insurance half sits in the no insurance guide at /fines/guides/no-insurance.

The usual route

There is no roadside route: the case arrives as a court charge, usually after the DVLA's medical file has reopened.

If it goes to court

Income-banded fine territory with a discretionary ban, usually downstream of the DVLA's own decision on the licence; mechanics in the fine bands guide.
